SHIPPING AND RETURNS, TERMS, CONDITIONS OF SALE


All sales of products by EQUIGAS, Inc. are subject to the following terms and conditions:

PRODUCT ORDERS

We will use our best efforts to fulfill all orders, however, EQUIGAS, Inc. cannot guarantee the availability of any particular product. EQUIGAS, Inc. reserves the right to discontinue the sale of any product at any time without notice. Upon receipt of your order, EQUIGAS, Inc. will send you confirmation that your order has been accepted by email.

PRICING

Product prices are subject to change without notice, and such prices do not include shipping and handling or sales taxes, if applicable, which will be added to your total invoice price. While our goal is a 100% error-free printing, we do not guarantee that any content is accurate or complete, including price information and product specifications. EQUIGAS, Inc. reserves the right to revoke any stated offer and to correct any errors, inaccuracies, or omissions (including after an order has been submitted and accepted).

PAYMENT

Payment is due in full within thirty (30) days from the date of invoice. A service charge of 1.4% per month will be applicable for all past-due payments.

WARRANTY POLICY – (PRODUCT DEFECT)

All products sold by EQUIGAS, Inc. are subject to the manufacturers’ warranty policy. EQUIGAS does not assume or admit any liability for labor, damage, or other claims arising from defective goods. As a distributor, EQUIGAS will help facilitate the warranty process between the customer and the manufacturer. A warranty form can be requested from EQUIGAS customer service department. Fill out the warranty form to begin processing a claim and hold onto the product until a determination is made by the manufacturer. Defective or damaged product should NOT be sent back to EQUIGAS without express authorization from customer service. If the Manufacturer decides that they need warranty product back for testing, they will issue a Return Material Authorization (RMA) and the product will ship directly back to the Manufacturer.

RETURN POLICY

Most products may be returned within thirty (30) days of delivery for a credit or refund. All products must be in their new and their unopened original packaging. To start the return process, call us at +1 (336) 790-3915 and we will provide you with detailed instructions on how to return your merchandise and provide you with a Returned Goods Authorization (RGA) number which is valid for fourteen (14) days. A valid RGA number must be included with your return. EQUIGAS, Inc.is not responsible for merchandise returned without a valid RGA number.

Except in cases where the return is a result of a shipping error or the item arrives damaged or defective, all returns shall be subject to a fifteen percent (15%) restocking fee.

Special orders and non-stock items are subject to the manufacturer’s return policy. Custom printed and manufactured products are not returnable for either credit or refund.

SHIPPING DAMAGE

EQUIGAS makes every effort to prepare shipments for safe travel. All freight shipments must be thoroughly inspected by the customer upon arrival. Inspection consists of confirming ownership (addressed and shipped to correct destination), confirming the count of all items shipped, and walking around the shipment, checking for dents, cracks, creases, holes, and any other sign of possible damage. EQUIGAS provides pictures of how shipments are prepared for shipping to aid in the inspection process. Delivery to a job site or a homeowner constitutes delivery to the consignee and the inspection process remains the same. If the consignee does not receive, inspect, or submit claims according to EQUIGAS’s written policy, the consignee is responsible for submitting the claim directly to the carrier. If the carrier will not let the consignee inspect the shipment, acknowledge damage, loss or allow the consignee to refuse the shipment, DO NOT SIGN ANYTHING and contact EQUIGAS immediately. Visible damages must be acknowledged at the point of delivery on the delivery receipt, or the shipment must be refused entirely. Damage to the packaging & wrapping constitutes visible damage and warrants opening the packaging to inspect further. Contact EQUIGAS customer service department with the tracking number, description of damaged goods, copy of the signed delivery receipt notating damage/exception, and photos of the damage. Keep the damaged product in or with the original packaging material if possible. While awaiting inspection by the carrier, the consignee must hold the damaged shipment and its contents in the same condition that they were delivered in. Concealed damage as a result of shipping must be disclosed to EQUIGAS within 48 Hours. Contact EQUIGAS customer service department with the order/invoice number, description and photos of the damaged goods along with photos of the packaging. EQUIGAS must prove packaging was intact when delivered in order to file a concealed damage claim.

All sales are F.O.B. EQUIGAS (Seller) locations, unless otherwise noted. Shipping and Handling Charges are included and invoiced as actual freight costs. Delivery of the goods to the carrier at Seller’s shipping point shall constitute delivery to Buyer and Buyer shall bear all risk of loss or damage in transit. Seller reserves the right, in its discretion, to determine the exact method of shipment, unless otherwise requested by Buyer. Seller reserves the right to make delivery in installments, all such installments to be separately invoiced and paid for when due per invoice, without regard to subsequent deliveries. Delay in delivery of any installment shall not relieve buyer of buyer’s obligations to accept remaining deliveries. Immediately upon buyer’s receipt of any goods shipped hereunder, Buyer shall inspect the same and shall notify seller in writing of any claims for shortages, defects or damages and shall hold the goods for seller’s written instructions concerning disposition. If Buyer shall fail to so notify Seller within five days after the goods have been received by buyer, such goods shall conclusively be deemed to conform to the terms and conditions hereof and to have been irrevocably accepted by the Buyer. Seller shall not be liable for any loss, damage or penalty as a result of any delay in or failure to manufacture, deliver or otherwise perform hereunder due to any cause beyond Seller’s reasonable control, including, without limitation, unsuccessful reactions, act of Buyer, embargo or other governmental act, regulation or request affecting the conduct of seller’s business, fire, explosion, accident, theft, vandalism, riot, acts of war, strikes or other labor difficulties, lightning, flood, windstorm or other acts of God, delay in transportation, or inability to obtain necessary labor, fuel, materials, supplies or power at current prices.

GENERAL

EQUIGAS’s principal offices are located in Greensboro, North Carolina - USA. These terms and conditions are governed by the laws of the State of North Carolina. The exclusive jurisdiction and venue for the resolution of any dispute(s) arising out of or related to the sale, manufacture, delivery or use of any product sold by EQUIGAS shall be the courts, tribunals, agencies and other dispute resolution organizations in Greensboro, North Carolina. If any part of these terms & conditions is invalid or unenforceable under applicable law, the invalid or unenforceable provision will be deemed superseded by a valid, enforceable provision that most closely matches the intent of the original provision and the remainder of these terms & conditions agreement shall remain in full force and effect.
